BTU (represented principally, of course, by WilmerHale) lost again. They filed a motion to dismiss Hayat's Amended Complaint. The trial court judge denied their Motion to Dismiss on 1/11/11 (except for Count II, as to Al-Mazeedi and Oishi but NOT Holdings). Bottom line, Hayat (44% owner) will finally "get his day in court" and have the chance to find out EVERYTHING that's been going on inside BTU since it was formed in 2002.
A list of all docket entries for the lawsuit are available electronically to everybody at many courthouses throughout the Commonwealth of Massachusetts. Also, members of the legal profession have remote access through the following website: Trial Court Information Center - Commonwealth of Massachusetts. All documents submitted to the Court are available (in hardcopy - except for those filed under seal) for anyone to view and copy at the courthouse in Woburn, MA. The Hayat as well as the McBrearty lawsuits are in Middlesex Superior Court.
As mentioned elsewhere in this blog, court filings (again, the only caveat is for documents filed under seal) for lawsuits in U.S. Federal Court (Murphy and Betancourt) are accessible to EVERYBODY through the following website: Public Access to Court Electronic Records.
