In the Murphy case discovery is supposed to have been completed.
In the Betancourt case discovery will end on July 1, 2011.
In the McBrearty case discovery ended quite a while ago.
So... if discovery has ended and "nothing" happens what does that mean???
The parties can file a motion for summary judgement. Meaning, in our non-expert legal interpretation, that if there are no disputes as to the FACTS, a judge can decide on the "legal" merits of the case... Summary Judgement.
If WAM's litigation against everybody has no "legal merit" at this stage.... He exposes himself to getting his A*S thrown out of court.... Question: why would WAM allow any of his litigation to get to this stage?
The "parties" could be negotiating a settlement... Settlements are supposed to be done in "good faith," meaning, that you are actually trying to achieve an equitable outcome for everybody... Settlement discussions could also be used to "pretend" to the court that you are making good faith efforts to come to a reasonable "conclusion" when your intent is to BUY TIME and postpone everything...WAM's dilatory tactics actually serve a legal purpose. WilmerHale provided him with the battering ram he needed to get him into US Federal and Massachusetts State courts. By throwing a ton of money and WilmerHale at the courts he manages to obtain preliminary injunctions (no issues of law or facts have to be "proved" for a judge to issue an injunction - only a "likelihood of something happening")
What comes next? Wael assumes (plans) on "litigating everybody to death." Throw BIG law-firms and tons of lawyers at everybody and eventually you will suffocate your opponent.
Everything seems to be going his way.... Except for the fact that all the individuals he was hoping to "rub out" are still around. As far as we know nobody has chosen to "settle" anything with him. If nobody has settled with him (or BTU Ventures, BTU Industries Holdings USA Inc - we don't know yet if he's decided to sue anybody using his latest toy, QGEN)... then... all litigation goes to TRIAL...
Al-Mazeedi will have at least four (4) trials running concurrently... Hayat, Murphy, Betancourt, McBrearty....
Wael is going to be testifying a LOT!!!
Sure would be interesting to see Wael Al-Mazeedi cross-examined. Depositions can be "sealed" but trials are supposed to be open to the public. Anybody could go into the courtroom to see WAM "explain" everything....

What happens to this blog, if BTU offers Betancourt $ to settle out of court? Will Betancourt take the money? Will be want a trail for all the shit he has had to deal with? Just wondering.
Same question about the Murphy and McBrearty cases? I wonder how long it will take for all 3 cases to be thrown out of court. It appears they are all still around.
I bet all are wishing for a trail so that they can voice there experiences with Mr. Al-Mazzedi.
